Registration of the opening of debt settlement proceedings and debt settlement

The enforcement authority sends a notification of the opening of debt settlement proceedings and the debt settlements to us.
The following details must be provided to be registered in the Register of Mortgaged Moveable Property:
Opening of debt settlement proceedings
- the name and organisation number of the enforcement authority or the court initiating the debt settlement
- the case number of the enforcement authority or the court
- the date of the opening of debt settlement proceedings
- the name of the debtor and their personal identification number
- the recipient of the claim
- information about any secured assets specifically included in the decision
- original signature of the enforcement authority or court, either on the decision itself or the accompanying letter
Debt settlement
- the name and organisation number of the enforcement authority or the court establishing the debt settlement
- whether the debt settlement is voluntary or compulsory
- the name of the debtor and their personal identification number
- the duration of the debt settlement
- the original signature of the enforcement authority or the court, either on the decision itself or on the accompanying letter
We require that the opening of the debt settlement proceedings is already registered before we can register the debt settlement. If the opening is not registered, the enforcement authority must submit the opening together with the debt settlement for it to be registered. Otherwise, the case will be rejected.
